Louisa County authorities have ruled as unfounded an allegation that a defense attorney threatened a prosecution witness in a murder case.
The allegation against John R. Maus prompted him to withdraw last month as defense attorney for Mathew G. Minster, who faces murder and other charges in the drug overdose in 2007 of Nichole Brockett.
Brockett's husband, Michael Brockett, a prosecution witness in the murder case against Minster, accused Maus of threatening him by saying that Brockett would lose custody of his children unless he committed perjury.
Maus has said he spoke with Brockett after he called Maus on Jan 30, but the attorney has called Brockett's allegation completely false.
"After reviewing all the statements and the evidence and doing our investigation, we've determined that there's no criminal violation," Louisa Sheriff's Maj. Donald A. Lowe said today. "There is absolutely nothing that we can see that would be criminal in nature."
Lowe declined to discuss details of the conversation between Maus and Brockett, citing the unfinished case against Minster.
Maus was in court today and could not immediately be reached for comment.
