State board suspends Staunton physician's license for 3 years

The license of a Staunton physician accused of having sexual relations with patients, verbally abusing a 5-year-old, smoking marijuana and other misconduct was suspended yesterday for three years.


The Virginia Board of Medicine approved the suspension in a 6-0 vote. The action averted a hearing on Dr. Charles K. Weisman, who offered to accept the penalty provided that he did not have to admit or deny the allegations.


Prior to acting on Weisman's proposal, Clay Garrett, an assistant attorney general, told the board that while he was not speaking in favor of it, "I do think it is a reasonable offer and I think you should consider it."


The board closed the meeting to discuss the matter, then returned to approve the license suspension. Three years is the longest period the board can suspend a license. After three years, Weisman can reapply for his license.


Eighteen witnesses were present at yesterday's hearing and prepared to testify.


Following yesterday's hearing, Weisman's lawyer, Michael L. Goodman, said that by accepting the settlement offer, the board avoided what might have been a two-day hearing with an uncertain outcome. In return, he said, Weisman does not have to admit or deny the allegations, something that could have a negative impact on any civil suit or criminal charges that might be filed against him.


Weisman has strongly denied the allegations.


Last month, a Staunton General District Court judge took under advisement for a year two misdemeanor sexual battery charges involving two former employees. Weisman, 45, who operated Blue Ridge Family Practice, must stay out of trouble for a year and avoid contact with the two former employees who brought allegations.
