Happy endings occur. As the Bush administration wound down, David Novak's nomination to the federal bench fell victim to obstructionism. Although a merit-based system embraced by Sens. Mark Warner and Jim Webb recommended him for preferment, his name never came up for a vote.
Novak made his reputation as a federal prosecutor. His cases included the conviction of Zacarias Moussaoui on charges related to 9/11. He fought on the front lines in the war against jihadist terror.
Novak deserved elevation to a federal judgeship, but it was not to be. The situation did not reflect poorly on his record but on those who declined to confirm him. The other day justice was restored as the judges of the United States District Court for the Eastern District of Virginia named him a magistrate judge in their realm.
