Richmond City Council drops panhandling ordinance
A proposal aimed at cracking down on panhandling in Richmond has been dropped, but it could surface again.
Facing a potential legal challenge by the American Civil Liberties Union of Virginia, three City Council members withdrew a proposed ordinance that would make it illegal to solicit contributions from occupants of motor vehicles. The offense would have been a misdemeanor.
The withdrawal was acknowledged at last night's meeting, but Councilman Bruce W. Tyler said he's working with the city attorney to redraft the ordinance to exempt nonprofit groups that submit plans that address safety concerns. The goal, he said, is to not interfere with the city firefighters' Fill-the-Boot Campaign to raise money for the Muscular Dystrophy Association.
He said he hopes a proposal can be reintroduced this fall that "allows for us to get people off the street that create public-safety issues and get them to the right organization to get help -- those who need it."
The ACLU had warned that the proposed ordinance violates the free-speech clause of the First Amendment.
"Richmond has the right to pass laws that maintain traffic safety and that protect pedestrians," ACLU of Virginia Executive Director Kent Willis said in a statement, "but without showing a compelling reason, it cannot trample on the First Amendment right to ask for money."
Also last night, the council voted 8-1 to approve a plan by Michael Pellis to build a two-story, four-condominium complex at 107 S. Colonial Ave., near Carytown.
Neighbors argued that the four units made the project too dense for the neighborhood, but council members disagreed.
"This neighborhood was made for density," Tyler said.
Pellis is an architect with Baskervill, where Tyler is a principal, but City Attorney Norman Sales said Tyler had no conflict of interest that would prevent him from voting. Councilman Charles R. Samuels cast the lone vote against the project.
Earlier, Chesterfield County Administrator James J.L. Stegmaier addressed the council and pledged Chesterfield's interest in working with the city to mutually serve residents. Mayor Dwight C. Jones has attended boards of supervisors meetings in Chesterfield and Henrico County and similarly called for greater regional cooperation.

I think they really need do something about them because not only are they bothersome at times they are a danger to themselves as well as others. This morning a lady knocked on my truck window and scared the mess out of me I almost ran the redlight because when I jumped my foot came off of the brake. Then I looked back and she was walking in the street causing cars to slam on brakes or swerve to miss her. I’m tired of driving to work every morning only to be harassed and sometimes cursed out because I don’t or won’t give them any of MY money. The ACLU needs to back up off of this one they’re probably not the ones being harassed by them. I would love to have a peaceful ride to and from work without having to hear “Do have any change?“
I’m glad I don’t work downtown any more. I hated dodging the bums on my lunch hour. Sorry.. but these are not the “unfortunate families” looking for help. If you choose that way of life, fine.. but don’t expect us to pay for it.
Once again that despicable organization known as the ACLU is on the wrong side of an issue. Those usless excuses for a human being with their signs need to be removed from our streets! Another important point also needs to be mentioned. If the fools who actually give them money would just STOP doing that…... then this trash would would not be standing on our street corners all day!
The city must do something to stop any form of panhandling. It makes our city look like trash and that we don’t have the services needed to take care of deserving individuals.
If the ACLU says panhandlers have rights, well I too have rights not to be approached by these lazy, no working bums who most of the time are better dressed and cleaner than I am. Oh but wait, I work for a living and get dirty at work.
Richmonder’s wake up they only want your dollars for alcohol or drugs. They are so many people that are fed free everyday here you would be surprised.
Please City Council do the right thing!
