Kaine does not anticipate stay for Beltway sniper

Virginia Gov. Timothy M. Kaine said today that he has not yet received a petition seeking clemency for convicted Beltway sniper John Allen Muhammad and has seen no evidence that would suggest he should receive a stay of execution.

"I know of nothing in this case now, that would suggest that there is any credible claim of innocence or that there was anything procedurally wrong with the prosecution," said Kaine, speaking on his monthly call-in radio program on WTOP in Washington.

"So I would know of no reason why clemency would be granted in this case."

Muhammad is scheduled to be executed on Nov. 10 for the slaying of Dean Meyers in Prince William County. Meyers was one of 10 people shot to death during a three-week rampage in October 2002 that stretched from Maryland to Ashland.

Muhammad lawyer Jonathon Sheldon has said Muhammad will appeal to the U.S. Supreme Court and ask the governor for clemency.

Muhammad's accomplice, Lee Boyd Malvo, is serving life in prison without parole.

Kaine also told WTOP political correspondent Mark Plotkin that stories of the White House telling New York Gov. David Paterson to pull out of next year's race for governor to clear the way for New York Attorney General Andrew Cuomo were "grossly oversold."

Kaine, the chairman of the Democratic National committee and a close ally of President Barack Obama, said he was not involved in any discussions between the White House and Paterson, nor was he aware that they had taken place.

But he did say that the White House is "a performance-based organization" that would likely have frank conversations with Paterson about his prospects to stay in office.

"I do definitely think the White House should have candid discussions with everybody," said Kaine, adding that he did not think he needed to be informed every time the White House wants to reach out to one of the party faithful in office.

The topic of re-election also came up with regard to the Virginia governorship. Kaine said that he would have run for re-election if Virginia allowed its governors to serve consecutive 4-year terms. Virginia is the only state that does not allow consecutive terms.

Kaine said that not allowing Virginia governors a second term makes it hard for anyone in the office to "build up momentum toward long-term improvements" in the state.

Kaine said he thought he would do "fine" if he ran again, but said now he is focused on helping to elect Democrat R. Creigh Deeds to the job.

Reading is fundamental, Dave. Cons wasn’t referring to the former GOP presidents. If, say, GWB was truly conservative, he wouldn’t have stuck the federal govt’s nose in my business like he did. R.I.F.

As for ‘creating an enemy’ - hardly. I’m just curious about people who are suddenly upset with “the direction of the country” even though most of the the current direction has been the norm for many years now.

Dave,  Aren’t your results generally the product of your performance? Most people who perform well have an optimal outcome and vise versa.

Maybe you and I are reading a different Constitution, but can you please elaborate on which amendments they are “end-run[ning]“?  To me, they aren’t messing with the Constitution, but rather people’s self-imposed entitlements (aka, I have the right to ___, but only because I think so and not because the Constitution says I do)

If Muhammad’s lawyer told Kaine that he could save $27.50 by giving his client a stay, I’ll bet he would grant it.

Graverobber: Who said I like them any better under Bush, et. al.? I didn’t. You want to create an ‘enemy’ help yourself, but I’m not playing that game. I do apologize about my ommission. The czars are indeed not communists—just fascists. If you think Bush, Reagan and the rest are ‘Cons’, then you need some remediation in political science.

First good job Kaine on the snipers he needs to go.  Next as far as Patterson goes talking with my family in New York everybody dislikes the Gov it is even said that his own administration doesn’t like him so why run a relection campaign when the writing is on the wall that you have no chance of being relected.  Finally coming from Maryland I find it so odd that governors in VA only get one term.  I don’t know how it is expected for a governor to really get his plan and agendas going in just one term.  Nothing happens that quickly.

Ah yes, Dave’s trotting out the “Czar” red herring. I’m sure you had similar concerns about the czars appointed by Nixon, Reagan and the Bushes, right? Your current concerns are in no way partisan and fear-based as a result of the BS fed to you by the Limbaughs and Becks of the world, I’m sure.

But at least you didn’t try to pull the “Czars = communism” stunt so beloved your fellow Cons.

The White House is a ‘performance-based operation’—- ?  What operations are they performing so well? Besides appointing a bunch of czars to try to end-run the Constitution, what else have they done? Do they consider Obama’s obsessive speech-making and public appearances ‘performance’? Most of us are judged in our jobs on RESULTS - not ‘performance’.
