McDonnell asks U.S. Supreme Court to reinstate anti-spam e-mail law

Virginia Attorney General Robert F. McDonnell today asked the U.S. Supreme Court to reinstate Virginia's anti-spam e-mail law.

Last September, the Virginia Supreme Court declared Virginia's tough Anti-SPAM Act of 2003 unconstitutional because it bars all anonymous, unsolicited bulk e-mails, including those containing political, religious or other protected speech.

The Virginia Supreme Court ruling tossed out the first felony spam convictions in the country against one of the world's most notorious spammers, Jeremy D. Jaynes in Loudoun County in 2004.
