Richmond man acquitted in shooting

A Richmond man was acquitted Thursday of charges related to a shooting last spring on Chamberlayne Avenue in the city.

After deliberating about an hour, a Richmond Circuit Court jury found Martin Lee Brown, 40, not guilty of aggravated malicious wounding and felony firearm charges in the March 29 wounding of a man at Chamberlayne and West Bacon Street.

Brown testified in his defense. Horace Hunter, his attorney, said Brown acted in self-defense after being confronted with a gun as he was walking home from work about 3:40 a.m.

The two men had been involved in an earlier altercation.

The Commonwealth’s Attorney is going to make it as difficult as possible for anyone who shoots and kills someone.

Sounds to me like these two guys need to be allowed to a good old fashioned duel. Pistols at 40 paces.

I have lived in a number of jurisdictions over the past 40 years and it never fails to amaze me how many times people charged with felony assaults/murders in Richmond are found not guilty!

Michael Hollomon and Michael Herring brag about a 76% conviction rate in such cases, but to me this means that 24% of the cases result in no conviction, because the evidence to support one is simply not there! 

An occasional “not guilty” verdict is the norm in such cases, but 24 per cent? Why are these cases brought to court, wasting taxpayers time and money, when the evidence is clearly not there for a conviction?

No doubt, somewhere in the future, during campaign season, we’ll hear about how many such cases Hollomon or Herring, or perhaps both, have prosecuted, without the notation that many such prosecutions were obviously without foundation.
