A fraudulent home-repair operator will spend nearly five years behind bars for bilking five of his customers of almost $15,000.

Albert Gilyard, 56, of the 8200 block of St. Charles Road in Henrico County was sentenced in Henrico Circuit Court yesterday to 10 years in prison with seven years suspended for two felony counts of construction fraud.

In addition, he was sentenced to 36 months with 18 months suspended for two misdemeanor counts of construction fraud, and 60 months with 55 months suspended for performing work without a license.

Gilyard, who was convicted in March, was responsible for $14,700 in losses, for work that was not done or partly done and for which he had been paid in advance, according to evidence. His five victims lost $1,700, $2,500, $2,500, $3,500 and $4,500. He was ordered to make restitution.

"A lot of it was roofing. Some of it was interior work, painting and things like that," said Henrico Deputy Commonwealth's Attorney Michael Huberman.

The fraud occurred from January to July 2008. -- Mark Bowes

Alot of time for $$$... and that cops son gets 12 months for hit and run, killing that man by running him down while that guy was riding a moped…Yeah, if you have money, if you know the right people and rub the right palms, you will not do any time in this state… ask any judge or prosecutor

Go sit in the Henrico Count Circuit Courtrooms and you will see what happens on a daily basis.  You will be suprised at what does and does not happen to the defendants.  I feel sorry mostly for the vitims.

Yeah, that seems extremely excessive!  This same court gave Sarah Haislip 10 months for DUI and Involuntary Manslaughter.  This dude got 5 months just for working without a license!

18 years, 13 of which suspended, for stealing $15,000.  That seems excessive.

He’s got to repay the money, so his victims aren’t actually harmed. He didn’t have a licenses (5 years for that also seems excessive) so his victims are at least partially at fault for not checking him out before hiring him.

I’m sure we can find examples of murderers and rapists getting less time.
