Man pleads to misdemeanor in slaying of Caroline teen

BOWLING GREEN — One of nine people charged in the fatal shooting of a teenager at a Sweet 16 party in Caroline County has pleaded guilty to a misdemeanor.
Dwight Leo Smith II pleaded guilty Wednesday to assault by mob and received a 12-month jail sentence that was suspended. The 20-year-old Smith had been charged with murder by mob, a felony.
Sixteen-year-old Raquel Hunter was fatally shot as he left a classmate’s birthday party in November 2007.
Smith went to the party with the other defendants, who authorities say fought with another group.
Commonwealth’s Attorney Tony Spencer says prosecutor’s couldn’t prove that Smith went to the party to fight.
Seven of the other defendants were convicted for their roles. One is awaiting trial.

In other words, someone involved in a fight in which someone dies is only guilty of a misdemeanor like driving over the speed limit? Doesn’t his presence in the fight imply an intent to do harm to someone? Even if he didn’t kill anyone, a misdemeanor seems mighty lenient.
