Lawyers for sniper ask governor to spare his life

Lawyers for convicted sniper John Allen Muhammad today asked Virginia Gov. Timothy M. Kaine to spare his life because the Persian Gulf War veteran suffers from “severe mental illness.“
In a statement released this afternoon, they contend Muhammad should not be executed because of his “brain damage, brain dysfunction, neurological deficits as well as his psychotic and delusional behavior.“
Muhammad, 48, and Lee Boyd Malvo, 24, were convicted in a three-week shooting rampage in October 2002 that killed 10 and wounded three in Virginia, Washington and Maryland.
Muhammad was sentenced to death for the Oct. 9, 2002, slaying of Dean Harold Meyers, 53, who was shot at a Manassas-area service station.
Muhammad’s lawyers said they met with Kaine’s staff yesterday and presented a compilation of audio interviews with lawyers, mental health experts and witnesses rather than a traditional written request for executive clemency.
They said that Muhammad mental illness was exacerbated by gulf war syndrome he suffered from his service as a sergeant during the first gulf war. They said a juror in the case would not have sentenced him to death had she known he was severely mentally ill.
Kaine spokesman Gordon Hickey said “the governor does not comment on clemency petitions.“

If am to be a watchdog about people making unsupported assumptions, then I am certainly required to avoid making assumptions myself.
I guess this sort of issue can really arouse emotions, including my own. I appreciate your hitting the big re-set button on reasoning.
Bones… I sense you’re talking about so-called “copy-cat” murders. I don’t want to murder someone because John Allen Muhammad did it, and based on how little it actually happens, I expect less than 1/100,000th of 1 percent of the citizens have these “inner-psychopath” thoughts.
And capital punishment costs so much because we spend 20 years giving the murderer every appeal plus a couple we haven’t invented yet. When we convict someone of intentional murder and sentence them to death, they should have three years of appeals, not 20. Will you, on the rare occasion, execute someone who didn’t commit the crime? Maybe, but we’re not talking about little angels here. 99.9% of these people have serious life-long criminal records and have committed crimes worthy of death before for which they haven’t been caught. There aren’t many people who wind up on death row as a banker with a reputable history. I’m not crying if they claim innocence, except for the hundreds of thousands of taxpayer dollars we’ve spent unnecessarily to give them three hots and a cot for 20 years.
Well Bones, I disagree w/your assessment about those who seek for Muhammed’s sentence to be carried out, I guess personal attacks take away from the discussion and I recant my earlier comments about the attorneys involved w/Muhammed’s appeals. They are doing their job(s) and are upholding the constitution.
I do wonder what your thoughts are on focusing on specific deterrence instead of general deterrence ensuring that Muhammed does not harm anyone again.
I do appreciate your advocacy for stiffer penalties for offenders and standing up for victims of crimes. That is something that we both can agree on.
Who said I have sympathy for Muhammed? That is another logical fallacy, that if you oppose capital punishment, then you are soft on crime. Muhammed is a psychopath. He is dangerous and cold-blooded, and he needs to be put away where he won’t harm anyone again.
This might surprise some of you, but I am of the opinion that Governor Kaine should not grant him Clemency. The argument by his attorneys to me does not meet the threshhold of overturning the sentence. So Kaine should uphold the law as he promised and honor the sentence as it was legally disposed.
I am against capital punishment as a practice. But it is not necessarily unconstitutional. And VA citizens want the death penalty. So it is. And so the Governor, who is also opposed to the death penalty, must override his individual opinion in favor of the demands of a citizenry who by and large favor the dark ages. Again, you have chosen, chosen a public safety policy that is an international embarrassment.
That doesn’t mean I don’t care about the horror of the murder of innocents?!? I spend every GA session advocating for stiffer accountability for offenders, and for improved resources for victims.

People, do you see what I mean? High profile cases like the sniper’s can bring out the inner-psychopath in others. Violence sparks violence, even State violence.
And research studies tell us that the costs of capital punishment is comparable to the costs of a life sentence. When you add up the rights to appeal, the attorneys fees, the careful treatment on death row, the cost of the actual execution, we’re not spending much more money by locking murderers away safe and sound.
How is it that so many of our allies across the globe execute no one, and have homicide rates that are a fraction of ours? If execution was such an effective deterrent, why do we not see the results?
bones: my barroom bile is not about victims rights. it’s about preventing future victims! and yes once you are convicted of a violent felony you should lose most of your rights. i am not a fan of capital punishment myself but if as a society we have decided to have capital punishment and sentence people to capital punishment then we should carry out capital punishment. if it were up to me these creeps would serve HARD LABOR time for the rest of there lives! but that might be cruel. like shooting someone from the trunk of your car isn’t. and if i suggest we sentence to hard labor you will label me as a barbarian. bones: please explain where your sympathy for this killer comes from? cause i can’t find any myself . and please explain where the line is between being a barbarian and real punishment for convicted criminals? i can’t figure out where you stand there. if not capital punishment what would you suggest we do with this murderer?

Thank you for at least recognizing that I do not express fantasies of violence. I am far from that.
Perhaps I should express more frustration towards how the story has been reported. It seemed that the attorneys were seeking glory and fame through defending someone who has carried out horrific acts. I realize that attorneys have a duty to adhere to, but I would personally not want to be in their shoes.
It is interesting that you continue to label me as “GOP-er”. My screen name is GOPer and I do not subscribe to either party, so please refrain from attaching me to a certain party and then accusing me of certain thoughts and/or convictions due to stereotypes of people who are in a certain party.
As far as my position(s) on the Constitutional rights of the accused John Muhammed, I base my thoughts on the Constitution itself. My thoughts are that Muhammed:
1) Had a right to a trial by jury.
2) Had a right to a speedy trial.
3) Had a right to a public trial.
4) Had a right to be informed of the criminal charges brought against him.
5) Had a right to be confronted by adverse witnesses.
6) Has a right to be assisted by counsel.
7) Has a right against cruel and unusual punishment. In the case for Muhammed, I would argue him sitting on death row for 5+ years (therefore becoming mentally dysfunctional) equates to cruelty. People on death row for a long period of time experience mental decline. So “Bones”, if these attorneys really cared about Muhammed’s well-being and life, where were they during those years?
Might have been said before… He killed 10 people. HE has LIVED for 7 yrs. longer than his victims did. Why keep feeding him? He killed, he should die. We should not be footing the bill for those who end others lives. I think dinner time is way past the end point for him.
I think what would be really nice and very appropiate…. Execute him in the Electric Chair and put it LIVE on TV in Prime Time viewing with a rating of “G”. Maybe the kids will see this and decide that crime will be dealt with in a very harsh manner.
