Lead singer gets time in ‘sexting’ case

A Virginia Beach punk rock singer will spend a year in prison after receiving a text message containing a nude image of a 16-year-old Louisa County girl, authorities said.

Christopher A. Atkinson, lead singer of the band Celebrity Gunfight, pleaded guilty today in Louisa Circuit Court, said Louisa Deputy Commonwealth’s Attorney Rusty McGuire.

A judge today sentenced Atkinson, 24, to three years in prison, but suspended two years.

Authorities said Atkinson met the girl when she went to see his band perform last year, and that the two had been in touch for about three months when Atkinson asked her to text him nude pictures of herself.

The girl used a cell phone to send him such a picture on Sept. 3, McGuire said.

She was trying to be like Milley Cyras,posing topless all over the internet at 15 years old. the minor should be punished also!

How come the 16yr old girl wasn’t charged with manufacturing/electronically producing pornographic material???? THAT is a class 5 felony, not to mention the additional charge for ‘sending’ it.

I know a family that this actually happened to.  ‘boys will be boys’ and all that, buddy # 1 sent (he thought) to buddy #2 a pic (both 16yr olds) and somehow it accidently went to the wrong number that just so happened to belong to a 12yr old girl that neither boy knew.  Buddy #1 got a years’ probation!!!

yeah maybe a fine, probation, some comunity service even but a year in jail is a bit extreme. why is this girl not being punished? because she is so young and innocent at 16? please you can assualt someone and get busted for drugs and not serve a year in jail. this guy must have had a lousy lawyer or no lawyer at all.

Wow I really feel safer now.  So glad that they got this career criminal off the street.  Sending a young man to the joint because someone sent him a picture?
Did he know the female was 16?  This really seems a bit over the top to me, really reactionary.

Maybe some details are missing, but if the girl simply sent a nude photo of herself to him, and he is jailed - will this not open the door for celebrities the world over for prosecution due to the actions of their groupies? I guess what I am asking is does any photo of a person under the age of 18 constitute child porn and if so would this not include the pictures our parents took when we were toddlers getting a bath? I understand the seriousness of the exploitation of children but if the photo was simply a nude photo presumably taken by her and it was not explicit in nature… anyway I just somehow do not believe that the child porn laws were written with this type of case in mind. On the other hand I suppose there could be more to the story. For instance if the adult would have been doing the picture taking, but then again the way kids tend to dress these days I suppose that the average public snapshot could qualify…
