Restaurant smoking ban heads to House-Senate negotiating committee

A Senate bill that would prohibit lighting up in any public restaurant in Virginia without a separate, ventilated smoking room is heading to a bipartisan negotiating committee.

That panel will be charged with forging a compromise that can pass both houses.

Both the House of Delegates and Senate yesterday voted to send Senate Bill 1105, sponsored by Sen. Ralph S. Northam, D-Norfolk, to a conference committee.

Northam's bill, which Gov. Timothy M. Kaine supports, would ban smoking in every public eatery that does not have a separate and independently ventilated room to accommodate those who wish to light up. It would exempt private clubs. Restaurant workers could not be punished or fired for refusing to work in a smoking area.

The House of Delegates yesterday insisted upon its amendments that would allow smoking in restaurants so long as minors are not present and would require only that a smoking area be separated from a nonsmoking area by a door.

Meanwhile, a House bill that contains the amendments that substantially weaken the proposed ban narrowly cleared the Senate Local Government Committee by an 8-7 vote.

Today the Senate is expected to refer House Bill 1703, sponsored by Del. John A. Cosgrove, R-Chesapeake, to the Senate Education and Health Committee. That is the next step in a process that lawmakers say will strip the bill of its significant pro-smoking amendments and route it to the same bipartisan committee of negotiators.

When the two bills wind up in the conference committee, negotiators will fashion one piece of legislation that they hope can pass the General Assembly and be signed into law by Kaine.

A compromise discussed by Senate Democrats and House Republican leaders would allow smoking in patio areas that serve as entrances to restaurants, so long as the flaps of any temporary patio enclosure are raised. The compromise also would extend the effective date of the law to Dec. 1, 2009, instead of July 1.

Conference committee members from both houses have not yet been appointed. Proposed legislation likely will come up for a vote early next week.

Timmy is back at it again.  What is the GA going to do when they loose all that tobacco money?  This bill needs to be killed.  There are places that don’t allow smoking. You anti-smoking people go there, if we want to smoke, then leave us alone!

RTD would never expose their Republican cronies.  RTD would never write an insightful inquisitive article about what is broken in Virginia politics.

When politicians vote for the minority of lobbyist’s interest and not the majority’s desires, they fail to serve their purpose.  Republicans serve one role…to protect friends and to protect the rich…Not once has the state of Virginia benefited from a Republican Governor ... and now those in the GA prove they are out of touch.

I will always cast my vote against backwards thinking Republicans…Eric Cantor is the king of the idiots…He has yet to do anything meaningful ... all he does is vote against every idea those who are TRYING to fix problems presents in the Federal Congress. 

Republicans can keep voting this down, until they get voted out of office for rejecting the loud clear voice of the majority (over 75 percent) of citizens requesting this ban. 

Good work to Governor Kaine and the Democratic process ... If they fail to do what you want, why do you vote for them…Next up, religious nut wacko right wing Bob runs for Governor…Didn’t we just boot out someone like him after 8 years in the White House.

Wake up Virginia, you aren’t being served by Republicans…Period

Only a niave person would think that just because they want something they will get it.  There are many more factors that go into this discussion than just Save the environment.  Otherwise many things we enjoy today would be banned.  How about “freedom of choice” The “GREEN” culture will not always win as many of their ideas go against what many people expect and demand.  Just because it is “GREEN” doesn’t mean it should be approved.  Fanatics always miss the whole point.

Dear RTD,
Please print the name of every member of the VA House and Senate who votes against the smoking ban, or votes to further weaken it.  I want to devote all my resources to defeating them in the next election.  There is something seriously wrong with an elected official who votes against our environment (clean air, clean water, healthy forests, etc.)  Virginia’s natural beauty is, and has always been, it’s major drawing card for tourism and growth.  Only an idiot, or a corrupt politican, would vote to destroy it.
