Va. asks for review of ex-Navy SEAL trainee case  08/20/09 12:01 AM

Virginia’s attorney general is asking the state appeals court to review a panel’s ruling that exonerated a former Navy SEAL trainee in the abduction and slaying of a Georgia college student. Bill Mims filed a petition Tuesday asking the full Virginia Court of Appeals to rehear the case of Dustin Turner of Bloomington, Ind. Mims questions the credibility of fellow trainee Billy Joe Brown, who said he alone killed Jennifer Evans while she was vacationing in Virginia. Mims says Brown’s two confessions were substantially different, but the trial court only knew about one of them.

Three days after a Virginia Court of Appeals panel overturned the one-time Navy SEAL trainee’s conviction in the 1995 murder of a Georgia college student, the state’s attorney general announced he was asking the full court to review the finding. “I have decided to seek review by the full Court of Appeals in the case of Dustin Turner,“ Attorney General Bill Mims said in a statement yesterday.

Virginia Attorney General Bill Mims will ask the full Virginia Court of Appeals to review a panel’s ruling that cleared a former Navy SEAL trainee in the abduction and murder of a Georgia college student. “I have decided to seek review by the full Court of Appeals in the case of Dustin Turner,“ Mims said in a statement. “The three-judge panel of the Court of Appeals was sharply divided. It is imperative that a case of such significance be decided by the full court.“

Former Navy SEAL trainee Dustin Allen Turner says he has sought forgiveness from the family of a young woman he watched die even as he’s been unable to forgive the actual murderer, a man who may win Turner his release from prison. Cautiously eyeing his freedom after serving 14 years in prison for a Virginia Beach murder of which a court has ruled he shouldn’t have been convicted, Turner said he recognizes the pain of the victim’s family.

A former Navy SEAL trainee convicted of the 1995 murder of a college student visiting Virginia Beach took his plea for freedom to the Virginia Court of Appeals in Richmond yesterday. Dustin Allen Turner, 34, and fellow SEAL trainee Billy Joe Brown, 36, were sentenced to 82 and 72 years respectively in the June 19, 1995, slaying of Jennifer Lea Evans in a parked automobile outside a Virginia Beach nightclub.

A former Navy SEAL trainee’s bid to be cleared of a murder conviction will be argued before the Court of Appeals of Virginia tomorrow. Dustin Turner, 34, is serving 82 years for the first-degree murder and abduction in 1995 of Jennifer Evans, a 21-year-old pre-med student at Emory University in Atlanta. The two had met at a Virginia Beach nightclub.

The Virginia Court of Appeals has set oral arguments for April 14 in the case of Dustin Turner, a former Navy SEAL trainee seeking release from prison after his co-defendant confessed to killing a young woman by himself. Turner, 33, has been serving an 82-year prison sentence for murder in the 1995 killing of Jennifer Evans outside a Virginia Beach nightclub. His co-defendant and former best friend, Billy Joe Brown, is serving a 72-year term for the same crime. When they were arrested, each man accused the other of being the killer.
